專利侵權管轄法院-美國-最高法院判決-TC Heartland v. Kraft Food

事實部分 本案緣起Kraft Food Group Brands LLC於2014年在District Court of Delaware對TC Heartland LLC提出侵權告訴，認為TC Heartland LLC販售的水中添加劑侵害其專利權。TC Heartland LLC主張該公司在Delaware並未有據點，僅有產品輸入而已，並有少量的營業額，於2013年的收入僅佔該公司2%，同時該公司註冊地不在德拉瓦州，亦無任何正式營業據點設立於該州。TC Heartland提起原告Kraft Food起訴的法院在法院聯邦民事訴訟法規定下"缺乏個人管轄權"的請願，要求撤銷告訴，或者移往Southern District of Indiana審理。 地院與CAFC都說不行，主要理由是以下兩個法條︰ 1. 28 U.S.C. § 1400(b)「專利侵權訴訟之適當審判地，為侵權人所在地，或其侵權行為發生地，同時並設有正式營業據點」（Any civil action for patent infringement may be brought in the judicial district where the defendant resides, or where the defendant has committed acts of infringement and has a regular and established place of business ） 2. 1990年CAFC所作出的VE Holding Corp. v. Johnson Gas Appliance Co.一案判例中，說明應同時參酌28 U.S.C. § 1391(c)，該條文要旨為「倘若受理侵權訴訟之法院，對被告當事人具民事訴訟對人管轄權（personal jurisdiction），同時該地區亦為原告專利權人主要營業據點，則可視為侵權人所在地以及適當之審判地」（an entity with the capacity to sue and be sued in its common name under applicable law, whether or not incorporated, shall be deemed to reside, if a d

專利權國際耗盡原則-美國-最高法院判決-Impression v. Lexmark

Lexmark提供二種方案給消費者。一種是所謂的「正常方案碳粉匣」（Regular Cartridge），價格是原價，對於這種碳粉匣，沒有使用或轉售的限制。另一種方案則是「回收方案碳粉匣」（Return Program Cartridge），比原價便宜2成，但受到「一次使用／不得轉售」（single-use/no-resale）的限制。消費者使用完這種碳粉匣後，只能交由Lexmark回收。 這篇判決主要關鍵是第2種 碳粉匣 受到「一次使用／不得轉售」（single-use/no-resale）的限制， Impression  回收這種 碳粉匣填充 後進口到美國，是否有權利耗盡patent exhaustion。 聯邦巡迴上訴法院 全院判決(CAFC en banc) 認為，當專利權人在銷售專利物時，同時向購買者合法且清楚傳達，該購買會受到「一次使用、禁止轉售」的限制，則該銷售並沒有給予購買者或後續轉得人「再銷售或再使用的授權（authority）」。由於第一次銷售時所給予的授權，已經合法限制了這種再銷售或再使用，故該行為仍然會構成第271條的侵權。 最高法院駁回上述判決，其 論述過程比較長︰ 首先是說，專利法保護創新，可以讓發明人取得應有報酬，一旦發明人取得報酬，專利法就無法對產品的限制使用提供基礎。(The Patent Act promotes innovation by allowing inventors to secure the financial rewards for their inventions.
